New Application for an Adult-Use Retail Dispensary License at a Non-Viable Location

The State of New York requires a 1,000-foot distance between retail dispensaries in NYC. Proposed retail sites that do not comply with NYS Cannabis Law are considered non-viable locations and can only be approved via a Public Convenience and Advantage (PCA) determination based on the seven regulatory factors below:

    • The number, classes, and character of other licenses in proximity to the premises and in the particular municipality or subdivision thereof.
    • Evidence that all necessary licenses and permits have been obtained from the state and all other governing bodies.
    • Whether there is a demonstrated need for the license.
    • The effect of granting the license on pedestrian or vehicular traffic and parking in proximity to the premises.
    • The existing noise level at the premises and any increase in noise that would be generated by the proposed premises.
    • The history of cannabis violations and reported criminal activity at the proposed premises.
    • Any other factors specified by law or regulation that are relevant to determining whether granting the license would promote public convenience and advantage of the community.
