1*. Consideration of Amendments to the Proposed Public Convenience and Advantage Regulations

On October 23, 2024, the Office of Cannabis Management proposed amendments to Parts 118.1 and 119.4 of NYS regulations to change the standards by which cannabis licensees and applicants would be granted waivers from location restrictions based on Public Convenience and Advantage (PCA). That proposed rule would attenuate the criteria necessary for retail cannabis dispensary locations to violate proximity restrictions to other licensees.

After the 60-day public comment period concluded with overwhelming opposition to the proposed amendments, it was determined that additional revisions should be made based on that feedback. As a result, a Notice of Revised Rulemaking must be published in the State Register, allowing for additional public comments. The current proposed revisions include:

  • A minimum set of distances within which a PCA request is not available
  • Prohibitions on PCA requests when more than one licensee is within a restricted zone
  • Notice to all existing licensees located within the applicable radius
  • Limits on requests until existing dispensaries have been in operation for at least nine months
  • Additional municipal notice requirements
  • Procedural requirements for submitting a PCA request
