SUMMARY:CANNABIS LICENSING - Mar Fitzgerald\, Chair; Patricia Laraia\, Vice Chair - IN PERSON ONLY
DESCRIPTION:(NOTE DATE CHANGE) – In person at the CB2 District Office Conference Room\, 3 Washington Square Village (near Bleecker & LaGuardia – Map) – Option to attend remotely via Zoom. \nThere will NOT be a hybrid option. \nSeating is limited in the Conference Room.  Pease register to attend in person to ensure there is adequate space. \nThis hearing is in-person only. Registration is required. \nPlease click here to register to attend. \nCLICK HERE: To submit questions or comments. \nSubmissions via the comment form will be addressed prior to live testimony. \n1*. Consideration of Amendments to the Proposed Public Convenience and Advantage Regulations \nAGENDA \nOn October 23\, 2024\, the Office of Cannabis Management proposed amendments to Parts 118.1 and 119.4 of NYS regulations to change the standards by which cannabis licensees and applicants would be granted waivers from location restrictions based on Public Convenience and Advantage (PCA). That proposed rule would attenuate the criteria necessary for retail cannabis dispensary locations to violate proximity restrictions to other licensees. \nAfter the 60-day public comment period concluded with overwhelming opposition to the proposed amendments\, it was determined that additional revisions should be made based on that feedback. As a result\, a Notice of Revised Rulemaking must be published in the State Register\, allowing for additional public comments. The current proposed revisions include: \n\nA minimum set of distances within which a PCA request is not available\nProhibitions on PCA requests when more than one licensee is within a restricted zone\nNotice to all existing licensees located within the applicable radius\nLimits on requests until existing dispensaries have been in operation for at least nine months\nAdditional municipal notice requirements\nProcedural requirements for submitting a PCA request\n\n\nBusiness Session\n\n\nCommittee evaluates\, deliberates on matters brought before them to reach informed decisions.\n\n3.   Vote \n\nCommittee formally decides on proposed actions\, resolutions\, or recommendations.
